Invenco represented Stichting EuroQol Research Foundation won a recent cancellation actions against the marks for “EQ” & “EQ & Device” under National Registration Nos. 31433 & 194651 for the services in Class 35, and the goods in Class 16 respectively  in Vietnam.

The National Office of Intellectual Property upheld the applicant in finding that Everbeauty Corporation, the owner of the marks “EQ” & “EQ & Device” had not used these marks in continuous period of 5 years.  

Under Vietnamese IP law, to initiate a non-use cancellation action against a trademark registration, the appellant bears the burden of proof to show the non-use of the contested trademark. If the burden is met, the burden of showing the use of the contested trademark will then shift to the trademark owner.
